What is murder? Murder occurs where a person who causes the death of a human being either intends to cause death or intends to cause bodily harm which they know is likely to cause death and are reckless whether death ensues or not.
In Canada, murder is classified as either first or second degree. For example murder is classified as first degree if:
First-Degree Murder: carries an automatic sentence of life imprisonment. Those convicted may be eligible for parole only after a minimum period of 25 years.
Second-Degree Murder: carries an automatic sentence of life imprisonment. Those convicted may be eligible for parole after a minimum period of 10 years.
Manslaughter: carries a maximum penalty of life in prison, however, in the event of a conviction most cases resolve with a much lower sentence.
Was there Provocation? Was the murder committed in the midst of a heated altercation wherein an individual loses some power of self-control.
Was the accused impaired by drugs or alcohol? Was the murder committed while under the influence of a mind-altering substance which negated the accused’s ability to form the intent to cause death.
